Habeas Corpus

A writ of habeas corpus is a legal tool used to enforce a superior right of possession to a child. In this type of proceeding, a judge is asked to issue an order declaring that one person has a superior right to the possession of a child. If granted, the writ of habeas corpus will require the person currently in possession of the child to appear in court with the child.
