These forms tell you about supported decision making, which is an alternative to guardianship. Most people with disabilities can manage their own affairs with assistance and guidance from a person whom they trust and do not need a guardian. During the 84th Texas Legislative Session in 2015, legislators passed new laws that make Texas the first state to have laws recognizing supported decision-making agreements as an alternative to guardianship.
Supported Decision Making Agreement
The Supported Decision Making Agreement is governed by the Supported Decision-Making Act, Chapter 1357 of the Texas Estates Code. This supported decision-making agreement is to support and accomodate an individual with a disability to make life decisions, including decisions related to where the individual wants to live, the services, supports, and medical care the individual wants to receive, whom the individual wants to live with, and where the individual wants to work, without impeding the self-determination of the individual with a disability.
This agreement may be revoked by the individual with a disability or his or her supporter at any time.
If either the individual with a disability or his or her supporter has any questions about the agreement, he or she should speak with a lawyer before signing this supported decision making agreement.

Authorization Form to Release Confidential Information Under a Supported Decision Making Agreement
The form at the link allows a person, provider or organization to release an individual's information, which may include protected health information to the supporter named in the Supported Decision Making Agreement. The adult with the disability is required to sign and date the form.

Sample Acknowledgment by Disability Rights Texas
Disability Rights Texas, might be able to provide free legal help to the individual with the disability on supported decision making. Disability Rights Texas is the federally designated legal protection and advocacy agency (P&A) for people with disabilities in Texas. Their mission is to help people with disabilities understand and excercise their rights under the law, to ensure their full and equal participation in society.
This form is a sample form that the organization, Disability Rights Texas, will have a parent and/or prospective supporter sign so that he or she knows and acknowledges that Disability Rifghts Texas would be representing the individual with the disability and NOT the parent and/or prospective supporter.
